Terms and Conditions
§ 1. General
These Terms and Conditions govern the rights and obligations between SBD Switzerland and its customers. By placing an order, the customer automatically accepts them. Deviations are only effective if we have confirmed them in writing.
§ 2. Delivery terms
Unless deviations have been confirmed in writing, the shipping costs listed under Shipping and payment options apply. Delivery within Switzerland normally takes two to three working days and is made to the address provided by the customer. If an ordered product is not available from stock, we will contact the customer. Our shipping partner is Swiss Post. SBD Switzerland sells its products exclusively within Switzerland and to Liechtenstein. If the customer provides an incorrect delivery address, SBD Switzerland may charge the shipping costs for a repeat delivery again.
§ 3. Orders
Orders are always subject to payment for end customers. No minimum quantity surcharges apply.
§ 4. Payment methods
Unless deviations have been confirmed in writing, the payment methods listed under Shipping and payment methods apply.
The following provisions apply to purchase on invoice and to payment by instalments (idealBILLING+).
Credit check and scoring
Fitgear Group GmbH reserves the right to obtain credit information about the customer in the course of processing the purchase in order to protect its own interests, and may pass customer data on to third parties for this purpose.
For this purpose, the personal data required for a credit check (first name, surname and address details) is transmitted to an external credit agency. CRIF AG, Hagenholzstrasse 81, 8050 Zurich, carries out a corresponding assessment of creditworthiness and credit standing using mathematical and statistical methods. The information obtained about the statistical probability of a payment default is taken into account in the decision on entering into, performing or terminating the contractual relationship.
The credit check is carried out in compliance with the applicable data protection provisions and with particular regard to your legitimate interests. Please note that only CRIF AG can provide information on which data was used to calculate your credit profile.
Purchase on invoice / reminder fees
The invoice is payable within 30 days. The invoice is paid on time if the amount owed is in the recipient account by the end of the last day of the payment period.
If the payment deadline is not met and no fixed due date has been agreed, the customer is placed in default by a reminder. In the event of default, the customer in arrears will be charged reminder fees (first reminder CHF 20.00, second reminder CHF 25.00). If the claim is still not settled after the reminders have been sent, Fitgear Group GmbH reserves the right to assign the claim to third parties or to instruct a debt collection agency, at the customer's expense.
Payment by instalments
With payment by instalments you can choose between two or three instalments. A fixed fee of CHF 24.00 including VAT is charged for the instalment payment method, in addition to the basket value. We assign the claim in order to process the instalment agreement. The instalments are payable as follows:
- Instalment due within 10 days of the invoice date
- Instalment due within 40 days of the invoice date
- Instalment due within 70 days of the invoice date
If one instalment is in default, the total amount becomes payable immediately.
Example with three instalments and a basket value of CHF 1,500.00:
- Instalment CHF 508.00 (CHF 500.00 goods value + CHF 8.00 share of the fee) due within 10 days of the invoice date
- Instalment CHF 508.00 (CHF 500.00 goods value + CHF 8.00 share of the fee) due within 40 days of the invoice date
- Instalment CHF 508.00 (CHF 500.00 goods value + CHF 8.00 share of the fee) due within 70 days of the invoice date
Legal and debt collection costs in the event of default
The level of legal and debt collection costs depends on the outstanding claim:

Disclosure of personal data
In the course of performing the contract, your personal data is passed on to the transport company instructed to make the delivery or to the relevant financial services provider, insofar as this is necessary for the delivery or payment of the goods.
§ 5. Conclusion of contract
The buyer undertakes to place the order on the terms stated on the website. Any error in an order must be reported to SBD Switzerland immediately.
§ 6. Transfer of ownership
In the case of consumers, we retain title to the purchased item until the invoice amount has been paid in full.
§ 7. Returns and right of withdrawal
In principle there is no right of return for products of any kind. Exceptions arise only in the case of defects in the delivered goods, an incorrect size (*) or a delay in delivery of more than two weeks without the customer having been informed in advance. In such cases the buyer has the right to withdraw from the purchase contract. The goods must be returned to SBD Switzerland. The customer bears the cost of the return unless otherwise confirmed in writing by SBD Switzerland. Further details on the returns process can be found under Returns & Exchanges.
(*) If a product does not fit, the goods can be exchanged for a different size. Socks of any kind, wrist wraps, lifting straps and knee wraps are excluded from exchange. A product can only be exchanged within 30 days of receiving the delivery. The product must first be returned to SBD Switzerland. The customer bears the cost of the return. If the customer wishes to make a second exchange after the first one, shipping costs of CHF 6.90 will be charged again. If the customer returns the product after a first exchange because they do not wish to keep it, the shipping cost will be deducted from the refund. The requested replacement is dispatched once the return has been received. Please get in touch at shop@sbd-schweiz.ch before returning anything.
§ 8. Offers and prices
All offers and prices on the website are non-binding and without guarantee. Errors and changes to goods and prices are reserved.
§ 9. Exclusion of liability
All products sold by SBD Switzerland are subject to the manufacturer's strictest controls. For this reason the manufacturer alone is liable for the quality of its products. The customer acknowledges that SBD Switzerland does not carry out an incoming inspection of the products delivered by the supplier. By placing your order you confirm that SBD Switzerland cannot be held liable for any complaints or complications.
SBD Switzerland is liable only for direct damage and only where the customer can prove that it was caused by gross negligence on the part of SBD Switzerland. Liability is limited to the price of the delivery in question. In particular, the customer has no claim in any case to compensation for damage not arising on the product itself, such as loss of production, loss of data, loss of orders and other indirect or direct consequential damage.
§ 10. Data protection
All data is treated confidentially and is not passed on to third parties. The customer agrees that their personal data may be stored and processed electronically within the scope of the business relationship. Please note that data collected under this provision is gathered and processed exclusively for the purpose of providing our services, in particular for order processing and accounting. Data is transmitted in encrypted form. No liability can be accepted for the security of data transmitted over the internet.

§ 11. Place of jurisdiction
The exclusive place of jurisdiction is CH-9245 Oberbüren.
§ 12. Severability clause and validity of the Terms and Conditions
By placing an order the customer accepts these Terms and Conditions. Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected. The invalid provision is immediately replaced by the relevant statutory provision. Verbal agreements require written confirmation to be effective.
